The Betrayal of America: How the Supreme Court Undermined the Constitution and Chose Our President »
Posted By gatitabonitasen 1 year, 11 months ago in Arts & EntertainmentWith the ongoing crisis of America being held hostage by a rogue, runaway executive branch, we thought it was time to return to the scene of the original crime that made this horror possible: the theft of an election from the American people by five members of the Supreme Court. It may be January of 2007 when we write this updated commentary on

Point #1. AT no time did Al Gore lead in Florida despite numberous recounts. It was as if the Dumercrats knew how many ballots they had punched out in mass (i.e. stuffed the ballot boxes). When they punched out dozens of ballots at a time they could not get a clean punch and left Dangling Chads. Which of course they wanted to count.
Point #2. Half truths and out right lies. Unless the term "counted votes" is used as in "Al Gore had 'X' number of 'counted votes' more that President Bush" then it is a half-truth followed by an outright lie.
The Electoral College does not "COUNT" the absentee ballots unless they could make a difference in the election. The Left Coast, California, was already overwhelming in favor of Al Gore. Because of this a multitude of absentee ballots from military personell, which were overwhelmingly in favor of President Bush, were never counted. These votes alone would have swung the popular vote to President Bush.

bush sued to stop the counting of votes. simple. he sued to get state election supervisors in florida to stop counting votes. the supreme court granted his wish so as not to throw the legitimacy of his coronation into question.
for someone who putatively hates "activist judges" he sure
didn't have a tough time begging them to grant him relief.
the equal protection argument was BS as the counties that we all live in still have divergent election systems. nothing was done. it was a hollow, empty opinion.

bush sued to stop the count just as news was coming out in the papers that it was ovrvotes that hadnt been counted that could change the swing of the election...175,000 votes coming out of democratic precencts that had voted for gore or bush and then written the name in on the write in line also....and altho this "spoiled" the ballot ,in a recount those ballots showing clear intent would of been counted, now not all of the 175,000 ballots voted gore but enough did that it would of changed the election,,,lance dehaven smith's book clearly documents all of this

Equal protection was still the law. Who are you to determine the importance of that clause? What you only want to take the parts that favor you. It was a legall election period. Although one party tried their best to STEAL it and they weren't Republicans! All the way from registering convicts
to giving smokes for votes to manipulating recounts. Which
leads me to Ohio and How the Democrats paid a person with COCAINE to get people registered, they got caught and were
proescuted (in the Bushes second election.)

The electors shall meet in their respective states, and vote by ballot for two persons, of whom one at least shall not be an inhabitant of the same state with themselves. And they shall make a list of all the persons voted for, and of the number of votes for each; which list they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate. The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates, and the votes shall then be counted. The person having the greatest number of votes shall be the President, if such number be a majority of the whole number of electors appointed; 271 Bush -266 Gore final vote count. In fact had the Court not told the Florida court to butt out the FL legislature was ready to submit the electorial votes for Bush. That is a fact.

walden3, The U.S. Supreme court ruled 7-2 that the Florida statewide manual recount was un-constitutional in that it violated Floridian's constitutional rights by not explicitly defining what would comprise a valid "vote" during the recount.

Let us not forget the states for restructuring districts to favor republican votes, Ohio and Texas..hmmm and look now at how many state reps are being found guilty of corruption. Texas supreme court has found the redistricting illegal, (after the vote and can't reverse it) and must be reversed. (too little too late) I'm surprised the democratic party hasn't challenged Ohio Supreme court, redistricting process as illegal.

Sorry, but the democrats have been restructuring districts to favor themselves (known as "gerrymandering") for all of the 20th century. It is not illegal. Only one district in Texas was deemed to have been "restrictively" redistricted, and all of the other districts were acceptable.
In Ohio there was nothing in the redistricting that was any different than what was previously done by the democrats when they held the congress.
In 2010, when the new census takes place, if the democrats are in control, they will do precisely the same gerrymandering of the districts in their favor as they have always done.
Stop using talkingpoints to make an argument. Learn the facts -- take a political science course at the local community college or a political parties course in regular college. One can audit the course if they are afraid of not making a passing grade.

I was in a state of horrified disbelief the whole time the robed ones were allowing the democratic process to be railroaded, continually asking myself how could this be happening n 20th century America. I finally got the message that if they tell lies often enough, the lies become the "new truth" and a(p)resident is (s)elected. Lies repeated equal truth, kind of like in the O.J trial.

Even the liberal New York Times recounted the votes in Florida and came to the same conclusion that Bush won.

The reality is that we do not have a one man - one vote system. What we are doing is electing people to vote for the president for us. This is called the electoral college. Until we get rid of this anacranitic way of doing things we will always run into this same problem on a close race. The electoral college was formed to protect states rights form a federal government. That is why it was put into the sysetem in the first place.
This is not the first time this has happened and won't be the last. It is time to get on with life and if we don't want this to happen again than we have to change the law about the electoral college.

Imagine, A President wins by less than ten votes on the popular vote and we did away with the electoral college.
We would be recounting the votes untill the next presidency.
We would have a National example of what happened in Florida
Because every State would have to be recounted and of course
the losing side would try all kinds of devious ways to decide
voter intent (Like some wanted to count pregnat aka dimpled chads). Then the poll worker would be the ones that decided the election. Also the more recounts the less reliable the
count more handling= more problems. What really got me was
poll workers who wanted to count chads if they only passed light these weren't really even chads and of course all these shenanigans were played by the losing team.
The electoral college is necessary especially in close elections, it however could be refined.

Minivan.
The electoral college was set up so that the states had some clout. It made a little bit of sense when it was first done because of the lack of cohesion in the 'United' States. It doesn't matter any more.
You would be having no more recounts than you do in any election. Your state governor isn't recounted every time you vote for him. Your congressman, senator or other representatives at a state and local level are very rarely recounted.
With the newer way of voting (Electronic with paper trail) it would be easy to recount the vote. Yes, you will always have acrimony when the vote is very close. However, I would like to have my vote count as well as be counted.
That is where most people feel the election was stolen from them. Gore had more votes. He should have won. But we have the electoral college so that means that we cannot be trusted to vote and that our vote doesn't count.
It is time to let the electoral college go.

Let us not forget that it was the Democrats who contested the legal recount under Florida state law that states that if an election is close then a recount is mandatory. The state did that and the results came out Bush, then Gore whined and demanded another recount and the state agreed. After Bush won again, the Democrats whined again and another recount was issued. Same results. All this time Gore went to court after court and was granted a recount, yet after the Florida Supreme Court there was only one court left the U.S. Supreme Court. I guess the Democrats felt that the Republicans shouldn't challenge them on any thing. As to Gore winning, he won the popular vote, but, as you will understand if you read our constitution, it is the electorial vote that elects a President. Only in a Sentetorial or Congressinal vote is where the majority of those voting elects an individual. Maybe some of you out there needs to go back to school and read up on civics and government affairs.

Toobin says Bush then told Gore that his "little brother", Florida Gov. Jeb Bush, had assured him that he won the state of Florida and for that matter the presidency of the United States.
"Let me explain something," Toobin quoted Gore as saying in his response to Bush. "Your little brother is not the ultimate authority on this."
maybe not but his daddy's appointments to the supreme court were.

Which is why they aren't elected. They don't need to make an impact on our lives. That's what the other two branches are for. They should remain free of partisan politics to interpret Constitutional Law and that's it. If they fear their jobs every 4 to 6 years they will be swayed by public opinion and lobbies in stead of making accurate rulings from the bench. As for Bush stealing the Election in 2000 if the best that the Dems could come up with was Al Gore no wonder you lost......Bush was ripe to be picked in '04 but again the Dems picked a hard core Liberal from Boston and then wonder why they lost....again. Everyone on the Internet seems to hate Bush but SOMEBODY voted for him or he would be in Waco and not Washington....

I cannot believe this is still a topic of discussion. The Florida State Supreme court made the controversial decision to extend the deadline for manual vote recounts past the constitutional December 12 deadline. Furthermore, the Court ordered that 215 votes in favor of Al Gore that were cast after the November 26 deadline be counted in the grand total. The state supreme court also ignored the equal protection clause, which would have forced the manual vote recount to cover every vote within the state of Florida; the court however ruled that only certain votes be counted within a select few Florida counties. The Supreme Court put an end to the recounts because they were flat out unconstitutional. The Florida state supreme court made an illegal decision.

The United States Supreme Court made the following statement about the Florida State Supreme Court's ruling: "[The] Florida Supreme Court established new standards for resolving Presidential election contests, thereby violating Art. II, §1, cl. 2, of the United States Constitution and failing to comply with 3 U.S.C. § 5."

The real issue here is that people cannot stomach that a man who garnered the lesser portion of the popular vote won. To make matters worse, this president is incredibly unpopular. If that's the case, then attack the electoral college system, not the outcome of the Bush/Gore election. Under the current system, Bush legally won. The Supreme Court did not skirt the rule of law or constitution in any way, unlike the Florida state surpreme court. Plus, every recount done after the election left Bush ahead, so even if the Supreme Court had ruled differently, it only would have delayed the inevitable. I hate to quote Scalia, but he is right. Bush fairly won the election. Get over it people. If you want to get rid of Bush, impeach him. Stop whining about what can't be controlled.

easy to say. when you take into account all of the mismanagement, dangerous and reckless acts that bush has engaged in how can we get over it?
you say get over it, like the scotus decision was just a bad referee call in a ball game. the ramifications of bush being coronated are still ripling through the world.

Walden3,
He says get over it like it happend 6 yeas ago and nothing you say or do will ever change it. We can whine all we want but we are stuck with the situation. It is time to deal with the reality rather than rehashing the old hurts.
If we really want to do something than we need to get rid of the electoral college. The problem with this is that a lot of states feel it gives them some power and they like it.
We the people have to decide to get rid of it because that is the only way it will ever be gotten rid of.
Talking about how dangerous or reckless bush has been or will be in the next 2 years will not change anything.

I think it's funny how the left loves to blame everyone but themselves. Ohit's the Supreme Courts fault. What about the fact Fl would not even have mattered if Al Gore won his own state. Maybe that should say something if you can't even win your home state maybe they knew something the rest of us didn't. Even Walter Mondale won his home state.

The Truth is that the US Supreme Court had no constitutional right to get involved in the election. That matter was for the Florida State Court to decide. The rightwingers on the Supreme Court saw their chance to select their preferred candidate. And that's what happened. None of you neo-con or right winger BS will ever change that.
